Frances discussed the rise of litigation funding in Scotland. This include what it is, how it works and recent case studies.
Restitution funded and Cat MacLean acted successfully in the case for property developer Derek Carlyle in a 2015 Supreme Court case against RBS. Together they highlighted how both firms worked together to reach a satisfactory outcome for the client.
Cat MacLean covered some of the practical issues around recent guidance from the Law Society on Legal Pricing and litigation funding from a solicitors perspective. This included preparation for applications, litigant agreements, cost, the ranking of success fees and uplifts, ATE and recoverability.
